Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Quitable ("we," "our," or "us") governing your access to and use of the Quitable mobile application and website (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

To use certain features of the Service, you must create an account by signing in with Apple or Google. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Impersonate or attempt to impersonate another person or entity
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use any automated means to access the Service without our permission
  • Introduce any viruses, malware, or other harmful code
  • Harass, abuse, or harm another person through the Service

Health Disclaimer

Important: Quitable is designed to support your journey to quit smoking or vaping, but it is not a substitute for professional medical advice, diagnosis, or treatment. The Service provides tools for tracking progress and partner support, but does not provide medical or health advice.

Always consult with a qualified healthcare provider before making any decisions related to your health, especially if you have underlying health conditions or are using nicotine replacement therapies.

We make no guarantees regarding the effectiveness of the Service in helping you quit smoking or vaping. Results may vary, and success depends on many factors including your personal commitment and circumstances.

Intellectual Property

The Service and its original content, features, and functionality are owned by Quitable and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

User Content

You retain ownership of any content you submit to the Service (such as your display name). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display such content solely for the purpose of providing the Service.

Third-Party Services

The Service may contain links to or integrate with third-party websites or services (such as Apple and Google for authentication). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of such services is at your own risk.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us at support@quitable.app. Upon termination, your right to use the Service will cease immediately.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL QUITABLE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to defend, indemnify, and hold harmless Quitable and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Quitable operates, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.
